Competition law

That could end up being quite expensive! Violations of competition law rarely go undetected these days. Leniency programmes, whistleblower protection laws and complaints from market participants are leading to an ever-increasing level of detection. Forward-looking advice and continuous adaptation are required. Our experienced specialists can advise you on all competition law issues. Our clients include national and international companies of all sizes, but above all medium-sized and owner-managed companies as well as foreign companies and their German subsidiaries.

Range of services

  • Transactions: Merger control
  • Cartel fine proceedings
  • Contract drafting and distribution systems
  • Litigation and cartel damages
  • Competition compliance

Merger control: We examine for our clients the necessity of merger control notifications and the material eligibility of mergers for clearance. If necessary, we notify the Federal Cartel Office or the EU Commission.

Cartel fine proceedings: We advise and represent our clients in cartel fine proceedings before the German Federal Cartel Office and the EU Commission as well as before German and European courts, including in the use of leniency programs.

Contract drafting and distribution systems: We review agreements between companies for clauses that violate competition law and advise our clients on drafting contracts in accordance with competition law. This way we ensure that contracts are also legally effective before the competition authorities and courts.

Litigation and competition damages: We advise and represent our clients in competition damages proceedings in which damages caused by cartels are claimed. Our lawyers are just as familiar with state court proceedings as they are with conducting arbitration proceedings.

Competition compliance: We examine our clients’ business for possible violations of competition law, train employees, develop internal control systems and help with their implementation.
